Delegation Issue on Dataverse Date Column when using a Variable from With()-Function

Hi,

I am just curious if someone else has the same issue as me or maybe even has an answer to my questions.

Since the switch to Power Apps Studio Version 3.23101.23 and all later Versions I encounter the following issue.

I want to filter a dataverse table based on a date-column against a temporary variable i created using a With()-function.

Prior to Version 3.23101.23 the filter was working as expected without any delegation issue.
After the update i receive a delegation issue without making any changes.
We already opened up a ticket with the microsoft Support for a specific app and if we rolled back the app to a previous version the issue was gone, so for this specific case we closed the ticket but i wanted to dig a little deeper and realised that this was not a problem to this specific app but to all new apps i would create within our environments.

To troubleshoot the issue further i did the following.

1. Create a complete new environment

2. Create a new solution

3. Create a new dataverse-table (called "table/tables") with one date-column (called "date")
4. Create a new App, added the table, one gallery and the following statement first

Filter(tables,date = Today())

Result: No Delegation Warning. Nice

5. Changing the Statement to the Following

With(
    {
        varDate: Today()
    },
    Filter(tables,date = varDate)
    )

Result: Delegation Warning. Not So Nice

btw. don't get confused by the difference of the code snippets ans the images...i am german 😄
the code is in "english" Power FX (so u could just paste it if u want), the screenshots in german.

Before i come to my Questions, u may be asking yourself, "Why would u use a With()-Function in this way?"
If u want to Filter something within a ForAll()-Loop u are not able to use Set() and UpdateContext() for filter-conditions that change within the loop. For Example u want to filter reservations from a reservations-table within specific timeframes for each day from monday to friday. With()-Variables are the easiest way to change values for a filter-conditions within a forAll loop. Another Way (which i am currently forced to use) is by using a collection and Patch(), but its much less readable...

So about my 3 questions:
1. Has anyone else encountered this issue or are u able to reproduce it?
2. Should this Delegation Issue be expected or not?

3. Why would it change with a Version-Update of PowerApps, without any more informations?

Regarding the last point (3.)
I understand that the PowerApps Team wants to improve performance and security and that, changes could lead to stricter delegation rules. 
However changes to existing delegation rules should be notified /posted in some way in advance in my opinion, so u could act early, but maybe i am bit too harsh in this instance, because in my personal case it lead to a rewrite of a lot of code 😄
